Empoli have failed in their appeal to gain a Uefa licence.
The Tuscan side were handed the chance to play in Europe next season following the outcome of the Italian match-fixing trial.
Empoli qualified for the Uefa Cup as a result of Milan being deducted 44 points because of their part in the match-fixing scandal.
However, Empoli missed the cut off date to apply for a Uefa licence to allow them to play in Europe next term.
Empoli appealed to the Italian Football Federation in a bid to win a reprieve, but the FIGC have rejected their claims.
It means that Milan could play in Europe next season, as they are hoping to take the place of Empoli due to the Tuscan side's lack of a licence to participate in the competition.

Wonder if Milan will be allowed to take their place. The point deductions were meant to make sure Milan did not get a European spot.
